Blog What Design Terms & Conditions
Effective for projects quoted on or after August 3rd, 2007; Updated August 2nd, 2007.

These terms and conditions are effective upon completion of the project order form AND the approval of the official quote. These terms and conditions are subject to change at any time and may be modified in any instance in which a designer deems it necessary to fit the specific project; this decision will only be made upon full consent of the designer AND the client.

1. Authorization and Specifications
Upon agreement of these terms of services, the client authorizes Blog What Design to create or improve a website and retains full access to any information needed to do so. Full authorization will be given (user and password information) to the selected hosting service including (but not limited to) blog access, FTP access, and control panel access. Additionally, every project will be published with the exact specifications provided within the quote. Designs are completed according to the specifications and requests given by the client on the project order form and resulting quote; we request that the client be as specific as possible in order for us to create the design desired.

2. Quotes
Blog What Design agrees to provide the client with a full quote detailing all the specifications of the project before the project begins. Any parameters outside of the quote will NOT be included in the project unless requested and charged at a later time. All quotes are based on an hourly rate of $75/hour. All quotes include the minimum total hours for the proposed project (charged at $75/hour) plus a buffer of three hours (not charged) to account for technical difficulties due to the designer’s fault. This three hour buffer does NOT include extra client requests or difficulties due to the client's activities. Your designer will detail in the quote how many hours they anticipate the project will take. Blog What Design does our best to calculate how many hours it will take to complete a project. HOWEVER, Blog What Design will not be held responsible if the designer runs into a problem or requires additional work hours. The designer MUST notify the client if they feel an aspect of the design process will incur additional fees. The designers has the right AT ANY TIME to postpone work until the client approves the additional hours needed to complete the select aspect of the project. A rate of $75/hour WILL be added to the final second payment, for ALL hours worked past the originally quoted time.

3.  Web Browser Compatibility
Blog What Design guarantees that each of our websites will work in the latest browser versions of: Internet Explorer, Netscape, Mozilla FireFox, Opera, and Safari. Additional browser/platform testing incurs an additional charge due to the extensive effort needed to code websites beyond the aforementioned browsers. Blog What Design’s guarantee does not cover AOL, text-based browsers, screen readers, hand-held browsers, or any requested special effect that we have advised against. In addition, we do not code for browsers in beta (or any other stage) of testing.
4.  Project Content
All project content must be supplied within 15 days of the start of the project to ensure that the timeline adheres to the projected deadlines.
5.  Assignment and Special Requests
Blog What Design will attempt to assign your project to the designer of your choice. However, in order to create the design within the requested time period, we may assign the project to another designer within the company. We also reserve the right to assign subcontractors wherever needed (any such additional prices will be included in the quote) to fulfill special illustration, coding, and design requests.

6.  Copyrights and Wrongful Usage
The images selected by Blog What Design are downloaded from a stock-photography website that requires no royalties after initial usage.  The use of any non-licensed forms of text, graphics, photos, designs, trademarks, or other artwork is the sole responsibility of the client. Additionally, it is the sole responsibility of the client to obtain proper licensing with the use of any blog or content management system.  The client will assume ANY liability and responsibility for wrongful use, and will protect and defend Blog What Design in ANY such instance in which such a situation may arise.

7.  Link Back and Credits
Any web creation, publication or technical support that is provided to the client or the client's website may display a reciprocal link on the website via graphic or text-link to http://www.blogwhatdesign.com to allow for a design discount. HOWEVER, this discount will be applied only in certain projects the designer feels necessary and is in no way a guarantee. In this instance, the client unconditionally guarantees that links back to Blog What Design will remain on the site until such a time that the design is no longer active and live on the internet. The client must also leave the link back to our website where the designer has placed it. Removal of this graphic and/or link is a violation of this agreement.
8.  Rates and Prices
Any changes to the template(s) after the approved, final product is launched will incur an hourly fee of $75/hour (unless personally arranged). Any additional work not listed in the initial quote will also incur an hourly fee of $75/hour. The client will be notified if such a situation arises. All posted rates are STARTING prices only, and signify the costs for a project at the MINIMUM specifications for that type of project. Additionally, all rates, specials, posted starting prices and published packages are subject to change at any time.

9.  Web Site Maintenance
Website maintenance is offered at a price personally arranged rate with the client. The rate will be charged per hour and MUST occur on a preset schedule or be at the client's request with at least two weeks in advance. Website maintenance DOES NOT include any of the services offered within the $75/hour additional editing rate. Website maintenance may include but is not limited to: textual page updates, basic sidebar additions, page posts, addition of product items, etc.

10.  Completion Date and Supplied Information
Our estimated completion time on most projects is a minimum of 30 business days from the date of payment (this excludes weekends and US holidays). This is a rough estimation for of a time frame and also depends on the complexity of the individual request. More involved projects will take more time. For each project a start date and a deadline will be provided. Please also note that the completion of your project depends on your selected designer's schedule. The client will be informed of the company's schedule upon placement of any order. Any extension past the completion date due to the client's failure to provide the necessary information within 60 days of received payment will incur a fee of  $50 per month past due.
11.  Drafts
Each custom quote accounts for a minimum of eight full hours for design research, development, and draft creation. The client must make sure that all changes are listed after viewing each draft. A designer may at any time inform the client that they have exhausted their services, and may choose to charge the $75/hour design charge for any further design work.

12.  Project Delivery and Refunds
It is the client's sole responsibility to choose a hosting service that provides the minimum requirements for installation of the selected platform. If a client is not sure of this, please consult the company before choosing a hosting service. Blog What Design will not be responsible if we cannot install your design on your website. Blog What Design will NOT offer ANY REFUNDS whatsoever. In the case that you are not satisfied with your design, we will offer our services to fulfill your request beyond your original order. Because of this, we urge you to be as specific as possible, including as many examples as possible on the project order form and fully agreeing to the official quote so that we may provide you with a suitable design. Additionally, no more than three hours will be spent to debug various features within the client’s website. Beyond this limit, the $75/h fee will be charged.

13. File Backup
It is the client's responsibility to backup any project files. Blog What Design will not be responsible for damaged or lost files after the project has been completed and closed.

14. Completion
After the quote has been fulfilled and the project is complete, brief instructions will be left with the client (or website administrator) on the use of the select CMS. The designer and client must both fully agree to the completion of the project by digitally "signing" or typing their name and date onto a provided project closure form. Closure of the project is expected promptly after the proposed deadline. Additional work beyond the quote (and deadline) will incur a $75/hour fee for all work. Deadlines may be adjusted after the project has begun only at the agreement of both the client and the designer.

15.  Usage
Blog What Designs sells the client the right to use any creation delivered. The rights to any photos, graphics, source code, and computer programs that are not transferred to the client remain the property of its respective owner. HOWEVER, rights to the project are only granted upon final payment for the project. Until this payment is made, rights to the project and any design elements remain under the sole ownership of Blog What Design. Additionally, we retain the right to display graphics and other web design elements from ANY project as an example of our work in our respective portfolios anywhere on the internet or as hard (printed) copies.

16.  Training
Blog What Design will offer training and/or custom directions provided in a text document at the rate of $60/hour. We urge clients to first view the user manuals and training materials offered by the respective CMS first. Training is NOT automatically included in every client's quote. Please SPECIFY this in your project order form if you would like to receive training and or directions.

17.  Payments
A 50% deposit must be made in order for any work on your project to begin. Once approval of the provided quote has been received, Blog What Design will provide the client with a deposit invoice. Payment must be made through Paypal (by e-check, credit card, or Paypal balance) or by personal (or business check) in USD before the project will begin. If payment is not made within 30 days of the start date of the project, the order will be deleted and removed from our systems. After the project has been fully launched on our test servers, the balance of the total payment is due. The website will not be uploaded until BWD receives the 50% balance. The balance may be sent in advance of final testing if the client chooses to do so. Additionally, all hourly charged work completed after the project has been launched will be billed in full after the modifications have been made
